Nothing in these terms and conditions excludes, restricts or modifies any condition, warranty, right or remedy implied or imposed by any statute or regulation which cannot lawfully be excluded, restricted or modified, which may include Part V of the Trade Practices Act 1974 (Cth) and corresponding provisions of State or Territory legislation. This website is provided to you by Dyson Appliances (Aust.) Pty Ltd ABN 50 073 072 509 of 8-10 Mangrove Lane, Taren Point NSW 2229 Australia ("Dyson"). By proceeding with a purchase, you are entering into a legally binding contract with Dyson.

  1. The trade marks and logos displayed on this site are trade marks of Dyson's parent company in the United Kingdom, Dyson Limited (except where indicated)). Nothing contained on this website should be construed as granting, by implication, estoppel or otherwise, any licence or right to use any trade mark or logo displayed on this site without the written permission of Dyson.
  2. Assume that everything that you read on this website is protected by copyright unless otherwise stated. You may only use material on this website for personal, non-commercial use. You do not have permission to copy, reproduce, republish, up-load, post, communicate, transmit or distribute in any way any of the contents of this website for public or commercial purposes without the written permission of Dyson.
  3. By using this website you agree to accept the laws in force in New South Wales as governing the relationship between Dyson and yourself. You also irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales or any other court having jurisdiction in Australia as may be nominated by Dyson. This site may be accessed throughout Australia and overseas. Dyson makes no representation that the content of this site complies with the laws (including intellectual property laws) of any country outside Australia.

Remember to check the Conditions when you use the website as we may change the Conditions from time and time and you will be subject to the Conditions in force at the time that you use the website. We may change the prices and availability of goods without notice to ensure they are as up to date as possible.
  5. We try to make sure all the information on the website is accurate, but if we have made a mistake and you spot it, please let us know. Please regularly update your computer’s virus protection software as we can’t guarantee that the website will be free from viruses.
  6. We may suspend or terminate access to the website without notice.

Buying from the website

  1. You acknowledge and warrant to Dyson that:
  2. you are an Australian resident aged 18 years or over;
  3. you will be liable for all costs, fees, charges and other amounts which may become payable to Dyson as a result of your use of this website;
  4. you are not breaching any requirement of any applicable law relating to the privacy of personal information by providing the information to Dyson; and
  5. all information (including credit card details) you provide to Dyson is true and complete.
  6. Your telephone order is an offer to buy from Dyson. All Australian orders should include a daytime delivery address and contact details. Dyson reserves the right not to accept an order at its sole discretion.
  7. Payment for the goods which you order must be made either by credit or debit card, cheque or money order.
  8. a) Payment for the goods with a credit or debit cards must be made by one of the following credit or debit cards: Mastercard, Visa. Your credit card will be charged at the time of Dyson receiving your order and prior to the time that the goods are dispatched and received by you. Dyson will provide you with an invoice number as confirmation of the order. If your payment is rejected by the card issuer your order will not be dispatched. Payment is made at your own risk.
  9. b) Payment for the goods with a cheque or money order. Your cheque or money order will be cleared before the goods are dispatched and received by you. If your payment is rejected by the bank or post office; your order will not be dispatched. Payment is made at your own risk.
  10. The prices of the parts and accessories (inclusive of GST), the applicable delivery costs and availability of the goods displayed on this website are subject to change without notice. The title to goods will only pass following payment in full.
  11. Delivery dates of the goods are intended to be an estimate only.
  12. Orders will only be accepted from and dispatched to street addresses in Australia.

Returns

  1. You may cancel your order at any time up to 14 days after receiving the goods by notifying us in writing.
  2. You must return the goods in their original packaging to us at your expense. Note that if you fail to take reasonable care of the goods we might not be able to accept their return. Otherwise, we will refund the full purchase price to you (excluding delivery charges) to the card you originally used for the purchase.
  3. Goods returned by you because of a defect will be refunded in full, including a refund of the delivery charges for sending the goods to you and the cost incurred by you in returning the goods to us.

Liability

  1. You need to check whether your site is suitable for the installation of the Goods.
  2. We hope that you will be totally satisfied with your order. Our liability for losses you suffer as a result of us not complying with these Conditions is strictly limited to the purchase price of the goods you purchased and any losses which are a foreseeable consequence of us not complying with these Conditions. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us.
  3. We will not be responsible for any indirect or consequential loss of any kind (including but not limited to loss of profits, revenue, or goodwill) howsoever arising in connection with your use of the website and any goods purchased.
  4. We do not limit in any way our liability for:
    • death or personal injury caused by our negligence;
    • under section 2(3) of the Consumer Protection Act 1987;
    • for fraud or fraudulent misrepresentation; or
    • for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
  5. If you do not comply with these Conditions, we will hold you responsible if we suffer any loss as a result.

Intellectual property rights

  1. The trade marks and logos displayed on this site belong to us (including, but not limited to, the British Allergy Foundation and Good Housekeeping Institute logos). You are not authorised to use any trade mark or logo displayed on this site without our written permission.
  2. Assume that everything that you read on this website is protected by copyright unless otherwise stated. You may only use material on this website for personal, non-commercial use. Please contact us if you would like to use any of the information for public or commercial purposes.
